Estimated Time Frame - For grandparent or stepparent adoptions(dependent upon BOTH biological parents consent forms)(Possibly 5 to 7 months or more to obtain a grandparent or steppaarent adoption in Fayette County, Kentucky. Mr. Boyd, adoption attorney, at (859)288-5107 can provide you with general time frame estimates and adoption procedures for other types of adoptions.
Procedures -
1st - If BOTH biological parents of child/children to be adopted are living and willing to sign an Adoption Consent Form in front of an independent attorney(NOT Mr. Boyd), who will explain to them what they are signing, then proceed to next step of calling Mr. Boyd, adoption attorney, for an appointment OR if there are problems with getting BOTH consents, then call Mr. Boyd for advice on how to proceed.
2nd - Obtain Full Names, Dates of Births, County and State of Birth, current mailing addresses, and Social Security Numbers of ALL parties including Adoptive Parents, BOTH Biological Parents, and child/children to be adopted. Then call Mr. Boyd, adoption attorney, for an appointment. However, if you are interested in an infant adoption, a foreign adoption such as a guatemala adoption, or other type of adoption, Mr. Boyd, adoption attorney, can provide adoption advice in these regards.
3rd - Bring retainer fee and copy of child/children's Birth Certificate(s) with you when meet with Mr. Boyd, adoption attorney, and Mr. Boyd may provide you with Adoption Consent Forms to be signed by the biological Mother and biological Father of the child/children to be adopted.
4th - Contact an independent attorney(NOT Mr. Boyd) to explain to the biological Mother and biological Father what they are signing before they sign the Adoption Consent Forms(in front of a Notary Public).
5th - Return signed Adoption Consent Forms to Mr. Boyd's office(Adoption Consent Forms must be held by Mr. Boyd for a minimun of 20 days).
6th - After the 20 day period, call Mr. Boyd, adoption attorney, to make an appointment to read the Adoption Petition. After your approval, you sign the Adoption Petition in front of a Notary Public at Mr. Boyd's Office. Mr. Boyd files the Adoption Petition at the Courthouse(you bring the Adoption filing fee).
7th - The Adoption Section of Kentucky Cabinet for Health and Family Services is contacted, who files their Report with the Family Court within 90 days of the date of the Adoption Petition being filed. During this 90 day period, you may be contacted by the Adoption Section in order for them to make arrangements to come to your home and complete a home visit. They may check for things such as a separate bedroom for each gender of child/children. They review other criteria as well. Mr. Boyd, adoption attorney, can provide additional details in this regard. Again, if this is an infant adoption, a foreign adoption such as a guatemala adoption, or other type of adoption, Mr. Boyd, adoption attorney, can provide adoption advice in these regards.
Also, the Family Court may appoint a GAL(Guardian ad Litem)(an attorney for the child/children to be adopted in the Adoption case). You are responsible for any GAL fee in the Adoption case.
8th - After the 90 day period is complete and the Cabinet's Adoption Section files their Report with the Famiily Court, Mr. Boyd files a Motion for an Adoption hearing. Again, if this is an infant adoption, a foreign adoption such as a guatemala adoption, or other type of adoption, Mr. Boyd, adoption attorney, can provide adoption advice in these regards.
9th - The Family Court may possibly set the final Adoption hearing in this adoption case. Bring to the final Adoption hearing Mr. Boyd's Court Appearance fee, any GAL fee, and the New Birth Certificale(s) fee for each child being adopted. If the Court approves and signs the final adoption decree, the adoption is complete.
